Premium Investor (Provisional) Visa

(Subclass 188D)

 


The premium Investor Stream is intended for business investors holding a significant amount of wealth who are willing to invest an amount of at least AUD $15,000,000 towards specified funds, investments and securities or to make a philanthropic contribution (a donation).

Like the Significant Investor Steam, the Premium Investor Stream does not require proof of certain minimum asset and other requirements (besides the proof of lawfully acquired and unencumbered $15,000,000 amount available) nor is there a Points Test that applies to this stream.

If you intend to apply for this visa it must be noted that any funds intended to be made towards the complying premium investment will be scrutinised carefully by the Department (DIBP) to ensure that lawful acquisition of source of finds, like the Investor Visa as well as the Significant Investor visa. Importantly neither the applicant (nor any spouse or de facto partner of the applicant) is permitted to have any “history of involvement in business or investment activities that are of a nature that is not generally acceptable in Australia” (Migration Regulations 1994).  

 

Additional subclass 188 requirements include showing a genuine intention to hold the complying premium investment for a specified period. Form 1412 is a requirement to be completed and it serves the purpose of specifically being a deed of acknowledgement that you are responsible for your own financial and legal affairs and undertake not to bring any action against the Commonwealth (of Australia) and release the Commonwealth from any liabilities in relation to any loss relating to the complying significant investment.

Once approved for a subclass 188, you may be entitled to apply for a subclass 888 visa provided you have met the specified length of time required in maintaining the investment along with all additional subclass 188 requirements.

 

 

Premium Investor Stream 188D requirements:

 

The Premium Investor stream is by nomination of Austrade on behalf of the Australian government only.

 

You must make a complying investment of at least AUD15 million in any of the following options:

  • Australian securities exchange listed assets.
  • Australian government or semi-government bonds or notes.
  • Corporate bonds or notes issued by an Australian exchange listed entity (or wholly owned subsidiary of the Australian listed entity) or investment grade rated Australian corporate bonds or notes rated by an AFS licenced debt rating agency.
  • Australian proprietary limited companies.
  • Real property in Australia excluding residential property.
  • Deferred annuities issued by Australian registered life companies.
  • State or territory government approved philanthropic contribution.

Income that you earn from your complying investment in Australia is subject to tax under Australian taxation law.

You must also have a genuine and realistic commitment to continue your business and investment activity in Australia after the conclusion of your provisional visa.

You, your partner (spouse or de facto), or you and your partner combined must have net assets of at least AUD15 million that are legally acquired, unencumbered, and available to be used to make the complying investment in Australia.

You and your partner must not have been involved in unacceptable business or investment activities.

You, your partner and other family members aged at least 18 must agree not to bring any action against the Commonwealth for any loss relating to your complying investment.
